Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to, and use of the website, applications, and services (collectively, the “Service”) offered by Mofa Foundation (“we”, “us”, or “our”). By applying for a grant, accessing or using the Service, you (“you”, “Benefactor”, “Applicant”) agree to be bound by these Terms.

Definitions

• Benefactor / Applicant: A person applying for financial assistance under one of our initiatives (Mofa Academy or Mofa Care).
• Institution: The school, hospital, or other organization which will receive funds from Mofa Foundation on behalf of a Benefactor.
• Grant: Financial assistance awarded by Mofa Foundation under a scheme.
• Genuine Application: An application verified to be authentic, truthful, and complete.

Eligibility & Scope

• Only Nigerians residing in Nigeria are eligible to apply.
• Applications are made under either Mofa Academy (education grants) or Mofa Care (patient support).
• Each Benefactor may submit only one application under each relevant initiative. Multiple identical or duplicate applications will be rejected.

• Mofa Foundation reserves the right to request additional information.

Disbursement of Funds

• If your application is approved, Mofa Foundation will not give the grant directly to Benefactors. Instead, funds will be paid to the relevant Institution responsible for providing the service (e.g. school for education, hospital or clinic for patient care).
• The Institution must acknowledge receipt and use of funds appropriately.

Conditions, Revocation & Misrepresentation

• Approval of an application does not guarantee indefinite funding. If at any point the application is found to be not genuine (false information, fraud, misrepresentation, or omission), we have the absolute right to terminate or revoke funding, even after disbursement.
• Benefactors found in violation may be required to repay funds (or proportion thereof), depending on the severity and as per our policies.

No Guarantee & Disclaimers

• Submission of an application does not guarantee approval.
• Decisions of Mofa Foundation are final. We may accept or reject applications without obligation to disclose reasons, though in many cases we may provide feedback.

Use of Website & User Conduct

• Users agree to provide accurate, current, and complete information when creating accounts or applying.
• Users must not impersonate others, submit false documents or information.
• Users must comply with any instructions regarding security of their account credentials, and notify us of any unauthorized use of their account or security breach.

Intellectual Property

• All content on Mofa Foundation’s website or in materials (text, images, logos, etc.) is owned or licensed by Mofa Foundation unless otherwise stated.
• Users may not reproduce, distribute, or otherwise use content without prior written permission.

Changes to Terms

• We may modify or change these Terms from time to time.
• When substantial changes occur, we will notify users via email or via a notice on the website. Continued use of the Service after changes implies acceptance.

Limitation of Liability

• Mofa Foundation is not liable for indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service.
• Our total liability under these Terms in any event is limited to the amount of the grant awarded or amounts paid by you (if relevant), whichever is lower.

Governing Law & Dispute Resolution

• These Terms are governed by the laws of Nigeria.
• Any disputes arising out of or related to these Terms or your application or grant will be subject to the exclusive jurisdiction of the courts of Nigeria.

Mofa Foundation (“we”, “us”, “our”) is committed to protecting the privacy and security of personal information of Benefactors, Institutions, visitors, and others who interact with our Service. This Privacy Policy describes how we collect, use, store, share, and protect your information, and your rights.

  • Personal identification information: Name, email address, phone number, physical address, date of birth, nationality.
  • Verification Documents: Academic transcripts, medical reports, identity documents, photos, or any documents submitted as part of the application.

Storage, Security, Retention

• With Institutions: Your data (or parts thereof) will be shared with the receiving Institution for purposes of disbursing funds and ensuring service delivery.
• Third-party Service Providers: We may engage trusted third parties (e.g. payment processors, verifiers, cloud hosting) to support our operations. They will only process personal data as needed and under confidentiality.
• Legal Requirements: we may disclose data if required by law, regulation, court order, or government authority.
